Terms of Service — plain English, no jargon.

The rules for using SparkIQ, written so a parent can actually read them. Our Privacy page covers what data we collect; this page covers who can use SparkIQ, how billing works, and what happens if something goes wrong.

SparkIQ is in early pilot. This page describes exactly what the product does today, in plain English. It is not a certified legal document, and we haven't claimed any compliance certification. A formal lawyer review of these terms is planned before the pilot opens beyond a small group of trial families. If anything changes as a result, this page will change too.

Who can use SparkIQ

  • A parent or guardian (18 or older) sets up the family account. You provide your email address, choose a 4-digit parent PIN, and agree to these terms on behalf of your family.
  • A child uses the app under that parent's account. Settings, plans and payments are locked behind the parent PIN, so a child can use the learning features but can't change plans, add payment details, or get past the parent area without it.
  • By setting up a family account, a parent confirms they are 18 or older and are the parent or legal guardian of any child profile they add.

Subscriptions and billing

Right now, payments are not switched on. SparkIQ is in early access: nothing is charged, no card is requested anywhere in the app, and no payment is processed. This section describes the pricing that will apply once paid plans open, so families know what to expect.

  • Learner plan: $19.99 AUD a month per child, or $179 AUD a year per child (over 25% cheaper than paying monthly). Includes every subject, every year level, the step-by-step tutor and the optional AI helper.
  • Exam Prep: $299 AUD a year per child, or a 16-week Exam Season Pass for $149 AUD per child.
  • Free trial: once paid plans open, every new family gets a 14-day free trial with full access — no card required, no obligation.
  • All prices are in AUD and include GST.
  • Cancelling: a parent can cancel a plan at any time, from the parent PIN screen inside the app — no calls, no forms, no waiting on us.

When payments do go live, this section will be updated to describe exactly how charges, renewals and refunds work, and you'll be told before anything changes for existing families.

Acceptable use

Nothing unusual here — just the ordinary stuff:

  • Don't try to bypass, trick or misuse the AI safety features (the content and distress checks, the daily usage caps, the age-appropriate guardrails).
  • Don't scrape, copy or resell SparkIQ's content or practice material.
  • Don't try to access another family's account or data.
  • Use SparkIQ for its intended purpose: helping a child learn.

Content and intellectual property

SparkIQ — the app, its design, and its underlying content and question banks — belongs to us. When SparkIQ generates practice material, explanations or feedback for your family, that material is licensed to your family for your own personal, educational use. You're welcome to print it out for your child; please don't republish or resell it.

No guaranteed outcomes

This matters enough that we say it in the terms themselves, not just the marketing pages:

  • SparkIQ provides original, exam-style practice material, freshly generated in the style of tests like NAPLAN, OC and Selective — never real or official past papers.
  • SparkIQ is not affiliated with, or endorsed by, NESA, ACARA or any exam authority.
  • SparkIQ does not promise or guarantee any exam result, test placement, or learning outcome. It's a tutoring and practice tool, not a substitute for a teacher, and results depend on many things outside our control.
  • For current official exam formats and real past papers, please check the relevant exam authority directly.

Service availability and changes

We may add, change or discontinue features as SparkIQ develops — that's normal for a product in pilot. We'll tell families about any material change that affects what they're paying for or how their data is handled. We don't promise the app will be available every moment (there can be maintenance, outages, or things outside our control), but we'll fix problems as quickly as we reasonably can.

Liability

SparkIQ is provided as a learning tool, used at your own discretion alongside your child's regular schooling. To the extent the law allows, we aren't liable for indirect or consequential loss arising from your use of the app. We keep this section short on purpose — we're not trying to sign away rights you're entitled to.

Nothing in these terms limits your rights under the Australian Consumer Law. Australian Consumer Law guarantees — for example, that a service is provided with due care and skill — apply regardless of anything written here, and nothing in these terms is intended to exclude, restrict or modify them.

Governing law

These terms are governed by the laws of New South Wales, Australia.

Changes to these terms

If we update these terms, we'll update the "last updated" date at the top of this page, and for any material change, we'll let existing families know directly (the same way we'd tell you about a privacy change). Continuing to use SparkIQ after a change means you accept the updated terms.
